Balancing The Principle Of Legal Certainty And The Principle Of Justice In The Application Of The First To File Principle In Trademark Disputes: A Study Of The Ms Glow And Ps Glow Cases

Abstract


Sengketa merek dagang antara MS Glow dan PS Glow merupakan contoh konkret dari ketegangan antara prinsip kepastian hukum dan prinsip keadilan dalam penerapan prinsip pendaftaran pertama. Studi ini bertujuan untuk menganalisis keseimbangan antara prinsip kepastian hukum dan prinsip keadilan dalam penerapan prinsip pendaftaran pertama serta bentuk perlindungan hukum yang diberikan dalam sengketa merek dagang. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan legislatif dan kasus, khususnya dengan menganalisis Putusan Pengadilan Niaga dan Putusan Mahkamah Agung. Hasil penelitian menunjukkan bahwa penerapan prinsip pendaftaran pertama tidak dapat hanya didasarkan pada formalitas pendaftaran, tetapi juga harus mempertimbangkan unsur itikad baik, penggunaan merek dagang yang sebenarnya, dan rasa keadilan untuk mencapai perlindungan hukum yang adil bagi para pihak.
